These Terms govern access to EarnersApp. By creating an account or using the platform, you agree to these Terms and the policies linked from them.
1. Platform operator
EarnersApp is operated by The Earners Group Proprietary Limited, registration BW00009669862, trading as Earnersapp, of Plot 22572, Phase 4, Gaborone, Botswana.
2. Eligibility and accounts
You must be at least 18, legally capable of entering the relevant transaction and permitted to use the platform in your country. Provide accurate information, maintain one lawful identity, protect your password and recovery codes, and notify us of unauthorised access. Verification may be required before selling, receiving certain payments or withdrawing.
3. Marketplace role
EarnersApp connects customers with independent sellers. Unless a listing expressly identifies Earners Group as the seller, the seller—not Earners Group—offers and fulfils the product or service. Earners Group may provide platform records, rules, payment facilitation and dispute support without becoming the supplier or employer of an independent seller.
4. Requests, offers and orders
A customer request is an invitation for eligible sellers to respond. A seller response must be accurate and made only where the seller can lawfully and safely fulfil it. An order is formed when the platform records acceptance or another stated commitment. The order record, displayed price, currency, scope, payment method and fulfilment terms form part of the transaction.
5. User conduct
Users must communicate honestly, respect privacy, avoid off-platform evasion, comply with safety and category rules, and not harass, threaten, discriminate, impersonate, manipulate ratings, create false transactions or misuse payment systems. The Acceptable Use Policy forms part of these Terms.
6. Payments, wallet and charges
Available payment methods vary. Users must follow the official payment flow and applicable provider terms. Wallet balances are platform transaction records and are not represented as bank deposits or investments. Fees, commissions, rewards, limits, holds, provider charges, reversals and withdrawal conditions may apply as described in the app and related policies.
7. Fulfilment, cancellation and refunds
Users must complete required fulfilment and payment confirmations truthfully. Cancellation and refund rights depend on timing, product or service, seller terms, provider rules and applicable law. See the Refund & Cancellation Policy.
8. User content and intellectual property
You retain responsibility for content you submit and grant Earners Group a non-exclusive licence to host, reproduce, display and process it as needed to operate and promote the platform. You must have the rights and permissions required for every photo, video, description, trademark or other submission. Earners Group owns its platform software, brand and original materials.
9. Restriction and termination
We may limit, suspend, investigate or close access where reasonably necessary for safety, legal compliance, fraud prevention, non-payment, verification failure, repeated complaints or breach of these Terms. Where appropriate, we may preserve transaction records, hold disputed amounts or require corrective action.
10. Disclaimers and liability
Marketplace availability, seller performance, location accuracy and third-party services may vary. To the extent permitted by law, Earners Group is not liable for indirect or consequential loss, user misconduct or events outside reasonable control. Nothing in these Terms excludes a right or liability that applicable law does not permit us to exclude.
11. Governing law and complaints
These Terms are governed by the laws of Botswana, subject to mandatory consumer or other protections that apply. Users should first use the Complaints Policy. Courts or other competent bodies retain jurisdiction as provided by applicable law.
12. Changes and contact
We may update these Terms for platform, provider, security, regulatory or commercial changes. Material changes will be communicated through an appropriate channel. Contact support@theearnersgroup.com.
